  • Use of threat or deception to gain control of the property

Illinois theft law classifies theft depending on three factors; the market value of the stolen property, prior convictions, nature or circumstances of the offense. The penalties for theft in Illinois vary from a misdemeanor to a Class X felony. 

Punishment for Criminal Theft in Illinois

There are a variety of charges, including:

  • Class A misdemeanor: Theft of property that is worth less than $500 may lead to up to one year in prison and fines of up to $ 2,500.
  • Class 4 felony: Theft of property that is worth less than $500 in a school, church, or government property. It can also include a person with a previous conviction. It can cause up to 3 years in prison and fines of up to $25,000.
  • Class 3 felony: Theft of property worth $500-$1000 - up to 5 years in prison and fines up to $25,000. 
  • Class 2 felony: Theft of property which is worth $10,000-$100,000 -  up to 2-7 years in prison and fines up to $25,000.
  • Class 1 felony: Theft of property that is worth $100,000-$500,000 - up to 4-15 years in prison and fines up to $25,000. 
  • Class X felony: Theft of property worth $1,000,000 and more - up to 30 years in prison and fines up to $25,000.
