So, what constitutes assault in Illinois?

According to 720 ILCS 5/12‑1, an individual commits assault by:

  • Attempting to strike or injure another person, or

  • Committing an act which puts a person in reasonable fear of immediate injury.

Illinois differentiates between assault and battery:

  • Assault = threat or attempt (no contact necessary).

  • Battery = intentional, unwelcome physical contact.

Types of Assault Charges

Based on actions, intent, and results, Illinois has a number of categories for assault charges.

Simple Assault

Simple assault in 720 ILCS 5/12‑1(a) is the intentional threat or attempt to cause minor physical harm. There is no weapon or serious harm.

  • Class C misdemeanor, punishable by a fine of up to $1,500 and imprisonment for up to 30 days.

  • Even a simple assault conviction results in a criminal record and can impact reputation and employment opportunities.

Aggravated Assault

Aggravated assault is more severe and involves elements like:

  • Intent to perpetrate some other felony during the assault;

  • Being aware of the victim's pregnancy;

  • Inflicting bodily harm or wielding a weapon.

Aggravated assault is typically a Class A misdemeanor or Class 4–2 felony, depending on severity, punishable by 1 year in jail to 6–15 years in prison.

Assault with a Deadly Weapon

Under 720 ILCS 5/12‑2(b), assault becomes even more serious when a deadly weapon is utilized or displayed.

  • Classified as a Class 2 felony, punishable by 3 to 7 years in prison.

  • If the victim suffers great bodily harm, the offense becomes a Class 1 felony, which carries a punishment of 4 to 15 years.

Juvenile Assault Cases

Assault offenses against children are tried in juvenile court with an emphasis on rehabilitation, not punishment.

A juvenile assault lawyer can frequently negotiate:

  • Diversion programs, avoiding formal convictions;
